Alternate (Panel) Chairperson
BC Review Board
The British Columbia Review Board is a quasi-judicial tribunal, established under the Criminal Code of Canada, whose mandate is to make decisions and issue orders concerning individuals whom courts have found to be not criminally responsible for acts committed while they were suffering from a mental disorder, or whose mental disorder renders them unfit to stand trial on criminal charges. It is the responsibility of the Review Board to protect public safety while also maximizing the rights and freedoms of mentally disordered accused persons. The Board holds hearings and exercises the authorities and obligations of a court.
The Alternate (Panel) Chairperson is a full time Order in Council appointment for an initial fixed term of 2 to 4 years, and is responsible for ensuring that hearings are conducted in a fair, expeditious and effective manner, in accordance with the requirements of the Criminal Code and principles of natural justice. He/she must consider oral and written evidence and submissions, assess the credibility of expert and lay witnesses and parties, and apply statute and common law to the found facts and merits of the case.
The Alternate (Panel) Chairperson will be a lawyer eligible for judicial appointment and could be a sitting or retired judge. Significant experience in criminal, administrative and forensic law, and adjudication are key. A clear and consistent communicator with excellent written and oral communication skills, he/she will be able to adapt his/her style to various audiences. This is an exciting opportunity for a legal professional, interested in public-service and adjudication within a criminal justice context. For the right individual, arrangements for less than full-time may be considered.
