Job Summary

Salary Range: $128,298-$184,428/year. The starting salary for this position would be determined with consideration of the successful candidate’s relevant education and experience, and would be in alignment with the provincial compensation reference plan. Salary will be prorated accordingly for part time roles.

 

 

Job Summary:

 

In accordance with the Mission, Vision and Values, and strategic directions of PHSA, safety, including both patient and employee safety, is a priority and a responsibility shared by everyone at PHSA’s Agencies/Divisions/Services, and as such, the requirement to continuously improve quality and safety is inherent in all aspects of this position.

 

Reporting to the Deputy Chief Legal Officer, Chief Privacy Officer (DCLO) the Senior Legal Counsel and Team Lead, Legal Services possesses strong leadership abilities to provide legal support and advice to leaders at PHSA and assist in managing the operations of the Legal Services department. The position reviews and drafts documents/contracts, conducts legal research, advises on risk management and other legal issues related to PHSA business operations in healthcare.  The position supports the DCLO in managing the provision of legal services to the organization and supervising and supporting the development and work of staff in the department.

 

Specific Portfolios:

  1. Workforce Management – this position has primary responsibility to provide and oversee legal support and guidance on matters relating to workforce and human resources management throughout the organization.  This includes matters involving physician contracts, medical staff privileges, workplace issues involving medical and non-medical staff, administrative law and regulatory compliance, employment, labour and human rights law, and risk management related to labour and employment.  This position also manages litigation and matters before administrative tribunals arising from performance management issues related to both medical and non-medical staff.

  2. Corporate – this position has primary responsibility to provide and oversee legal support and guidance on commercial agreements and corporate matters, including services and funding agreements, collaboration agreements, software licences, intellectual property arrangements and corporate policies.  This position also assists with medical staff contracts, as well as privacy and data sharing matters.

 

Duties/Accountabilities:

  • Provides expert legal support and guidance to PHSA senior leadership, staff and clients and other members of legal services team to enable effective decision-making.
  • Responds to a variety of legal issues that affect the healthcare industry and the business operations of PHSA.
  • Provides overall leadership and direction to team members using effective management techniques (e.g., coaching, mentoring, skill and leadership development, performance management). Inspires team toward the achievement of organizational and departmental goals through ensuring the culture is one in which individual competencies can thrive.
  • Reviews, researches and prepares legal opinions that may have significant impact to the organization, its programs and services and to staff.
  • Advises on new and existing legislation applicable to healthcare and the impact to the organization, programs and services, and staff.
  • Negotiates, drafts and revises legal documentation, including contracts, with external parties on behalf of the organization.
  • Anticipates and identifies legal issues and advises managers and directors on legal strategies and solutions to mitigate legal risk.
  • Has primary accountability for legal support and guidance on commercial agreements in relation to healthcare services, medical staff relations and governance, real property transactions, intellectual property and litigation and claims management.
  • Represents the organization at various hearings, court and/or tribunals and presents arguments.
  • Represents Legal Services on PHSA and provincial committees related to assigned portfolio.
  • Maintains professional growth and development through seminars, workshops, and professional affiliations to keep up-to-date with industry trends, developments, revised legislation and new regulations.
  • Assists the DCLO in other corporate governance and organizational legal matters that arise.

 

Qualifications:

  • Law Degree from a recognized University supplemented by a minimum of ten (10) years’ recent, related experience.
  • Experience in healthcare and a degree in Business Administration and/or knowledge of business management an asset.
  • Current member in good standing of the Law Society of British Columbia or eligible for membership within a specified period.

 

Role Specific Qualifications:

  1. Workforce Management– Substantial knowledge of and demonstrated familiarity with employment, labour, human rights and administrative law issues.  Experience advising on medical staff privileging issues and physician agreements would be highly regarded.

  2. Corporate – Substantial knowledge of and demonstrated familiarity with contract law, intellectual property law, and healthcare law.  Experience advising on information technology agreements and privacy/data sharing arrangements would be highly regarded.

  • Substantial knowledge of and demonstrated familiarity with the legislative and regulatory framework governing healthcare.
  • Expertise in analyzing, researching, evaluating and interpreting legal issues.
  • Exemplary legal writing and preparation of correspondence, summaries and reports.
  • Expertise in providing legal opinions and advice taking into account and understanding the needs of others to achieve helpful results.
  • Effectively communicates both verbally and in writing to a variety of audiences.
  • Expertise in negotiating and drafting legal documents.
